Terms of Use

These Terms of Use ("Terms") govern access to and use of the SMX — Strategic Management Experience ("SMX", "the platform"), operated by Micael Jardim. By accessing the site or signing up, you fully agree to these Terms.

1. The service

SMX is an executive education platform with Harvard-style interactive case studies. Content is provided in English and Portuguese, mobile-first, and may include text, images, video and automated assessment with feedback.

2. Signup and access

To access a case you provide your email. By doing so, you declare that:

You are responsible for keeping your email access confidential and for every activity done under it.

3. Plans and payment

We offer two commercial plans:

Payments are currently processed via PIX (Brazil) with manual confirmation by our team within 4 business hours. We will shortly integrate Stripe for international card and boleto payments — this section will be updated.

4. Right of withdrawal and refund

Under the Brazilian Consumer Defense Code (Law 8.078/1990, Art. 49), you may cancel your purchase within 7 (seven) calendar days of payment with a full refund, provided you have not completed more than one paid case. Requests after this period or after completing cases are not automatically eligible for a refund but are evaluated case by case.

5. Intellectual property

All platform content — cases, texts, adapted frameworks, interfaces, SMX brand, SMX Degree — is protected by copyright and belongs to SMX or is used under license. Logos of companies mentioned are property of their respective owners and used in an editorial/educational context of commentary and analysis, under Brazilian copyright law (Law 9.610/1998) and equivalent fair-use principles.

You receive a personal, non-exclusive, non-transferable license to access the content under your plan. You may not: copy, resell, redistribute or use the content to build a competing product.

6. Certificates

Certificates issued by SMX are private recognition documents. They do not carry official academic validity under Brazilian Education Law (LDB, Law 9.394/1996) and do not replace diplomas or regulated certifications.

7. Availability and support

We aim to keep the platform available 24/7 but do not guarantee uninterrupted availability. Scheduled or emergency maintenance may occur. Email support: response within 2 business days (priority for SMX Certificate holders).

8. Limitation of liability

SMX content is educational. No case or feedback constitutes consulting, investment advice or guarantee of business outcomes. You assume responsibility for decisions made based on the content.

To the maximum extent permitted by law, SMX is not liable for lost profits, indirect or consequential damages arising from the use of the platform.

9. User conduct

You may not: (i) share credentials, (ii) try to bypass paywalls, (iii) scrape content in an automated way, (iv) publish platform content on social networks or any public channel without written authorization. Violations may result in immediate suspension without refund.

10. Changes to these Terms

We may update these Terms. Material changes will be communicated by email to registered users and the "Last updated" date at the top will change. Continued use after the change implies agreement.

11. Governing law and venue

These Terms are governed by Brazilian law. The court district of Brasília/DF (Brazil) is elected to resolve any disputes, without prejudice to privileged jurisdictions granted by law (consumer protection).
